"The Safe and Secure Innovation for Frontier Artificial Intelligence Systems Act" is one of the latest laws proposed in California. Introduced by State Senator Scott Wiener, it aims to establish a comprehensive regulatory framework for developing and deploying artificial intelligence (AI) systems, particularly those identified as "frontier AI."
 
The case for the law 
The bill categorizes a covered model as an AI trained with significant computing power or meeting specific performance benchmarks that align with state-of-the-art foundational models. This classification also includes models that, despite having less capability, are of generally similar capability to the frontier models.
 
Before training an AI model, developers must ensure that it is unlikely to have or develop hazardous capabilities. This involves a proactive approach to AI safety, unlike typical regulatory frameworks that might only address issues post-development.
 
 Developers must implement stringent cybersecurity measures and conduct safety assessments. They may need to undergo a regulatory approval process before training models that do not meet the initial safety criteria.
 
The problems 
The proposed measures potentially stifle AI innovation by burdening startups and large corporations. The concern is that such regulation could limit the development of new, open-source AI models that are pivotal for technological advancements and cost reduction.
 
The definitions of "frontier" AI and the thresholds for what constitutes a "covered model" under the bill are comprehensive. This could lead to unnecessary regulation of AI systems that don't pose significant risks simply because they meet a computational threshold or vaguely defined capability standards.
 
The bill mandates that developers apply the precautionary principle before training AI models. This approach requires proving a negative (that the AI will not develop hazardous capabilities), an extraordinarily high and possibly unachievable standard for AI development. This could inhibit the development of new AI technologies, as developers might be reluctant to invest in innovative projects due to the risk of failing to meet these stringent safety criteria.
 
The proposed regulatory framework is extensive and could impose significant financial and operational burdens on AI developers. This includes costly safety assessments, cybersecurity measures, and a continuous review process. Such requirements could disproportionately affect startups and smaller enterprises that need more resources than giant corporations, potentially stifling competition and innovation.
 
 Due to the rigorous and potentially costly regulatory requirements, the bill could effectively outlaw new open-source AI models. Open-source models are crucial for widespread innovation and accessibility in AI, enabling researchers and developers to build upon each other's work. Restricting these could slow down the pace of AI advancements globally.
 
 The requirement for developers to make a "positive safety determination" under threat of perjury introduces significant legal risks. The ambiguity in verifying that an AI model will not develop hazardous capabilities could deter innovation, as the legal consequences of an error are severe.
 
Given California's leading role in the tech industry, the regulations could have a nationwide impact, affecting how AI models are developed and used across the United States. There's a risk that this could erode the U.S.'s competitive advantage in the global AI landscape.
 
 Instead of imposing such restrictive measures, a more balanced approach could be pursued. This might involve more targeted regulations that focus on specific high-risk applications of AI, increased funding for AI safety research, and collaborative efforts between the government, academia, and industry to establish practical and effective safety standards.
